Holding Agreement: A $500.00 deposit is required to hold your puppy. The seller assigns the buyer the guarantee that the dog will not be sold to any party other than the buyer. The $500.00 deposit is non-refundable and will be applied to the purchase price of the dog when the buyer assumes physical possession of the assigned dog. You may pay using PayPal, Cash or personal check as detailed by seller. We require full payment by pick up of puppy. Puppies may be picked up at Tried and True Aussies no sooner than 8 weeks of age and only after full payment has been received. NOTE: If buyer is unable to pick up their puppy at the normal age of 8 weeks, arrangements can be made for Tried and True Aussies to board your puppy. A boarding fee of $45/day will apply to any pups who stay past the age of 8 weeks.
Guarantee:
This puppy is guaranteed to be in good health, to the best of the seller’s knowledge. If he/she wishes, the buyer has 72 hours, from the date of ownership in which to have the puppy checked by a licensed veterinarian. IF THERE IS A PROBLEM THAT CANNOT BE RECTIFIED, you may return the puppy to us, at your expense, on the day following the vet exam, along with a veterinarian’s statement stating the problem. You will receive a full refund of the purchase price. (Exclusion: This does not include the presence of parasites and also does not apply to a health problem resulting from an injury or accident due to your negligence). All medical expenses are the sole responsibility of the buyer.
Viral, bacterial colds or infections such as Coccidia or Giardia (bloody stools) are a form of worms/bacteria which are easily treated and are not covered in the health guarantee as they are natural things puppies can pick up. Umbilical Hernias also referred to as “outie” belly buttons are also not covered in the heath guarantee. Puppies are naturally at risk for coccidia or giardia or worms which is often brought on by the stress of a new home, new food, new people, or just a change in environment. 2 Buyers Initials: ______________
All of our dogs come with a 1 year health guarantee for genetic conditions that are life altering. These will need to be determined by a licensed veterinarian, OFA for hip dysplasia and it it is an eye issue will need to be confirmed by a CERF certified veterinarian. We will not pay vet bills but will provide a replacement puppy from our next appropriate litter.
We will extend our Hip and eye guarantee 2 more years (3 years total) against genetic moderate or severe hip dysplasia, and retinal eye disease. Because 60% of all canine hip dysplasia is related to poor nutrition, we require that your puppy stays on Life's Abundance Dog food and NuVet supplement in order to qualify for this 3 year health guarantee. Remember, an ounce of prevention is worth a pound of cure! If you continue with Life's Abundance dog food and NuVet supplement for the 3 years, we will extend the guarantee against genetic moderate or severe hip dysplasia, and retinal eye disease until the dog is 36 months of age.
The OFA is the sole and only judge in determining hip dysplasia. A CERF certified veterinarian must confirm any hereditary eye defects. Purchaser is to spay or neuter (unless already done) the puppy and keep him/her as a companion.
The buyer(s) shall provide proper nutrition, vet care, shelter and exercise. The pup shall be socialized properly after all immunizations given, to include other people outside the family, other dogs, and strange places. Obedience classes are recommended before the pup is 1yr old. Also keeping an Australian Shepherd reference book can be helpful to refer back to, please call with any questions, we want to help you.
In regards to hereditary defects, there are never any full guarantees that a dog will be free of a genetic disorder from past generations, even with genetic testing done. While we do our best to avoid potential weaknesses in a dog, we believe that the diet and lack of vitamins can exacerbate these conditions if found. Therefore by providing the dog with quality food and supplements, we are hoping to reduce the chance of these potential weaknesses from hindering their quality of life, should this ever occur.
This puppy is being purchased as a pet and therefore the following applies:
Provided this puppy is kept on the Life's Abundance food and the NuVet supplement for the first 36 months, this dog will be guaranteed against genetic moderate or severe hip dysplasia, and retinal eye disease until it is 36 months of age. The OFA is the sole and only judge in determining hip dysplasia. A CERF certified veterinarian must confirm any hereditary eye defects.
The original buyer of the dog has the right to a replacement puppy from the next available and comparable litter if one these conditions occur in the first 36 months, considering the following criteria have been met:
1. The original buyer must own the puppy.
2. The puppy must not have sired or whelped a litter.
3. The puppy must not have been overfed or over-exercised!
4. Buyer must show veterinary statement of diagnosis of hip dysplasia by the OFA or retinal atrophy (progressive) by CERF., along with a copy of the x-rays or vision exam results prior to the 26 months of age and a spay or neuter receipt stating dogs name, description and microchip number.
5. Buyer must have fed this dog the Life's Abundance Nutritional System for the first 36 month.
If these conditions are not met then this contract will be void and non-binding.
First Right of Recovery: If buyer is unable to care for or chooses to change his/her mind about caring for the puppy purchased, Tried and True Aussies retains the right of recovery of the puppy at the buyer’s expense or will help buyer to re-home puppy/dog. There is no refund for a returned puppy. The buyer must notify Tried and True Aussies as to the change in circumstances and before any other action is taken. This includes and is not limited to selling the dog to another buyer. This pup must NEVER be sold to a pet store, broker, or puppy mill. This puppy must not be surrendered to a shelter, or sold out right to anyone without contacting us first. We must be notified immediately of any problems that arise or if buyer cannot care for puppy/dog anymore. Buyers Initials: ______________

Your puppy has been raised on Life’s Abundance Premium Health Food. Buyer’s can buy it online at www.lifesabundance.com/triedandtrueaussies. It is a dog food with no wheat, corn, or by-products.
Please note: providing a higher nutritious valued food, helps to lessen bone problems, to have fewer vet bills, and to promote longer life.
Buyer Acknowledges and affirms that Tried and True Aussies has recommended, for the benefit of the puppy, Life’s Abundance Dog Food and Supplements; however, the use of these products is merely a recommendation of the Breeder, not a guarantee of their effectiveness or efficiency.
We are in no way responsible for any vet bills made after puppy/dog leaves the care of Tried and True Aussies.
Tried and True Aussies shall not be responsible for death or injury of said puppy/dog due to negligence or carelessness of the Buyer.
Tried and True Aussies has the right to, at any time; decide to stop breeding Australian Shepherds and Aussiedoodles. In this case, no replacement puppies shall be given and this contract is null and void.
Tried and True Aussies makes no guarantees regarding the loss of the puppy due to accidental death, theft, sickness due to lack of vaccinations, etc., or any other loss beyond our control except as stated above.
Tried and True Aussies will not refund money in whole or part for any reason other than stated in the guarantee.
I acknowledge that this is a legal & binding contract and have reviewed and agree to the terms listed above. The buyer will also maintain up to date vaccines, wormings, and to keep the puppy/dog in humane conditions and provide proper food, water, and shelter. Failure to follow the above contract completely will result in “A Breach of Contract” and shall make this contract null and void. This contract applies only to the original purchaser and is NOT transferable. When a deposit is received by Tried and True Aussies the Purchaser automatically agrees to the terms of this contract, even if both the Breeder and the Purchaser have not yet signed the contract.
